Booking Terms and Conditions of Kilibound Adventures Company.
Bookings and subsequent contracts shall be deemed to have been concluded in Tanzania and shall be interpreted according to the laws of the United Republic of Tanzania.
The Kilibound Adventures Company reserves the right to decline any booking without outlining the reasons for it.
DEPOSIT, PAYMENTS & RESERVATIONS
A deposit of 30% is required at the time of booking and balance at least 30 days before the tour begins.
Clients/Agents booking within six (5) weeks of tour departure are required to pay the full amount immediately to secure the reservation. All bank charges are to be settled by the client or agent respectively. This includes transaction fees charged by our bank.
The amount shown on the invoice is the amount that needs to reflect in our account and should bank charges have been deducted, we would have to invoice you subsequently.
BOOKING AMENDMENTS
For amendments of existing bookings done by the client/ agent (e.g. departure dates, air tickets, accommodation, number of participants etc.) a handling fee of 50 USD per booking applies. The handling fee will be charged in addition to the service provider fees.
CANCELATION POLICY
Up 21 days prior to commencement of arrangements the payment will be refunded less a nominal charge. Cancellation less than 21 days will incur varying charges up to a maximum of 50% of the cost of the arrangements. They take effect from the day we receive cancellation in writing.
In the unfortunate event that we have to cancel a safari, Kilibound Adventures will return all monies paid or offer alternative services of comparable standards.
Cancellations must be sent in writing to the office that confirmed the reservation. Cancellations shall only be effective from the date of receipt of cancellation by the booking office. In case of a booking cancellation, the Company shall return the full deposit.
If a booking is cancelled the client is subject to a cancellation fee as follows:
3 months prior to departure – 25% Cancellation Fee
3-2 months prior to departure – 50% Cancellation Fee
2-1 months prior to departure – 75% Cancellation Fee
less than a 1 month prior to departure – 100% Cancellation Fee
The Kilibound Adventures Company reserves the right to cancel any tour at its sole and absolute discretion, without prior notification in instances where this is unavoidable. However, in that case the Company agrees to refund all monies already paid by the client. This shall be the Company’s sole responsibility to the client and no claim for any damages, howsoever arising, shall accrue against the company as stated in our Booking Terms and Conditions.
ACCOMMODATIONS
Prices are based on double / single occupancy/family suite. Single rooms on safari cannot always be guaranteed due to limited space. Should an accommodation fall to provide single occupancy despite payment of supplement, the applicable amount is refundable. Accommodations are listed in preferred sequence. They range from modern hotels/lodges/resorts/luxury tented camps/normal campsites. Most have private bathrooms and swimming pools and all have full restaurant and bar facilities. Kilibound Adventures works closely with our accommodation partners.
ALTERATION TO TOURS
The sequences and accommodation of all itineraries is normally adhered to but we reserve the right to make alterations enforced by whether, roadworks, high season congestion or other causes. Any delays caused by natural calamities i.e. whether condition, road blocks etc. will not be the liability of the company.
PASSPORTS, VISAS & TRAVEL PAPERS
It is the client’s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations and any other documentation required are all in order for the countries to be visited.
The Kilibound Adventures Company cannot be held liable for any consequences, damages or claims if the client does not attend correctly to the client’s documentation and related matters prior to commencement of the tour.
LIABILITY
Kilibound Adventures and its agents act only as agents of the client in all matters relating to accommodation, sightseeing, excursions, tours and all forms of transport. The company cannot accept any responsibility for default whether negligent or otherwise on the part of any of the services or accommodations with which the booking is made or which clients arrange themselves, nor is it not liable for clients additional expenses occasioned by their delay, alterations of travel services, sickness, injuries or as a result of weather, civil disturbance whatsoever interfering with, interrupting, altering or adding to the cost of services, excursions or tours applied for and booked.
The company’s liability to passengers carried in vehicles as used for transfers, excursions and tours is governed by the laws of Tanzania, Zanzibar and Kenya and all claims are subject only to the courts of the nations concerned.
The company reserves the right to employ sub-contractors and in the event to such exercise of such right the terms of clause (a) relating to the Company’s liability shall apply.
Whilst every care is taken the Company cannot be responsible for loss or damage to personal property and it is advisable to arrange relevant insurance.
MARKETING
The Kilibound Adventures Company reserves all the right to use any photographs and videos taken during tours for marketing or any other advertising material. The client hereby gives consent to use such photographs and authorizes the Kilibound Adventures Company to retain copyright for these photographs and such material.
AUTHORITY ON TOUR
The decisions of the Kilibound Adventures Company’s guide/driver on tour shall at all times be final and binding. The client must at all times comply with the laws, customs and foreign exchange regulations of all countries visited.
TRAVEL INSURANCE
All customers travelling with Kilibound Adventures are required to have fully comprehensive travel insurance.
The policy needs to be valid from the date that the initial order is placed so as to provide cover for a cancellation prior to departure.
During travel the insurance needs to provide comprehensive medical, evacuation and repatriation cover
VALUABLES
Please keep these with you at all times. Safety deposit facilities are available at most accommodations with Kilibound Adventures.
BAGS, BAGGAGE & SAFARI GEARS
At any time, all bags, baggage & safari gears and personal effects are at the client’s responsibility and the Kilibound Adventures Company does not accept any liability for any loss or damage of any personal effects, howsoever arising.
Clients are entitled to one bag of not more than 15 kg (backpack or soft bag – no hardtop suitcase) and a daypack. The Kilibound Adventures Company reserves the right to refuse excess baggage.
While on safari one piece of baggage is permitted per person, plus the hand rucksack. All excess baggage is advised to be left behind with us/hotel or lodge until the end of tour/safari then it will be given back to you.
Please notice that on our trekking tours and on some “bush” flights other baggage regulations may apply.
RISK
The client accepts that all tours are of an adventurous nature and involve an element of personal risk. Neither the Kilibound Adventures Company nor any of its agents can be held liable in any way for any injury, loss of life or damage to property, howsoever caused. The client hereby indemnifies the Company and will hold the Company, its agent, assigns and servants harmless from any such claim. The client accepts full responsibility for all risks involved.
PRICES
These include all expenses connected with vehicle and driver /guide, sightseeing as indicated in itineraries, entrance fees to the places to be visited, accommodations, service charges, government taxes, bed and the breakfast, half board, full board accommodations. Prices exclude the cost of passport, visa, health documents gratuities, laundry, drinks and other personal items, Airport landing and departure fees. All prices are subject to change without notice in advance based on increased rates and / or fluctuation in foreign currency and oil prices etc.
Price Changes:
All our prices are based on the current national park fees and taxes. Should the authorities decide on increasing fees and taxes, even though they might currently not be scheduled, we would subsequently have to pass on these increases.
